Cricket ID Online
You can use your Cricket ID online account to access the Cricket ID online website. However, there are some restrictions. The website is only available for users who are at least 13 years old. Users under the age of 13 should not create a Cricket ID account. They should always check the terms and conditions of the site before using it.
You grant Cricket a worldwide, royalty-free, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, create derivative works from, distribute, perform and display your Profile Information
Cricket reserves the right to terminate this license at any time. If you have violated the terms of this License Agreement, you may take legal action. Depending on the jurisdiction, you may be subject to a fine of up to $1 million. In any event, you must promptly notify Cricket in writing of any such claim or infringement. Cricket will use reasonable efforts to resolve the issue.
By submitting your Profile Information to Cricket, you waive any moral rights you may have in the information you submit. Cricket may also set general practices for use of the Site, such as the maximum number of days to retain uploaded Content, the maximum number of email messages per account, and the maximum disk space for users.
You indemnify Cricket from and against any claim, proceeding, loss, damage, fine, penalty, interest and expense
Cricket is not responsible for any damages caused by your use of the Services. Cricket makes no warranty or representations as to the accuracy, reliability, or completeness of the Service. The Service may not be compatible with your device, which can cause performance and other issues. It may also result in the loss of data and software on your device.
You must agree to arbitrate any dispute that is brought against Cricket under this Agreement. An arbitrator will make a determination about the merits of your claim based on the evidence presented in the arbitration proceeding. You may be able to pursue the dispute in court if you wish, but in most cases, it will be resolved by arbitration.
You waive any right to trial by jury
When using Cricket ID Online, you waive certain legal rights. For example, you waive any right to trial by jury and any right to class action arbitration. This is important because certain laws restrict the use of electronic records in certain jurisdictions. Similarly, you waive any right to receive and retain non-electronic records.
You waive any right to class arbitration
If you're unhappy with a service offered by Cricket, you can bring a claim against Cricket directly, rather than filing a class action lawsuit. This way, you'll avoid the time, money, and trouble associated with class-wide arbitration. But be aware that you may still be able to collect damages through a class-action lawsuit if you want to.
While you can still receive the same award as if you filed a class-action suit, you cannot expect to win as much money as you could in a class-action lawsuit. The same rules apply to arbitration as they do in courts. To begin with, it's important to understand that Cricket will pay all costs of arbitration unless you can demonstrate that you've been wrongfully charged.
